1. General conditions

Access to and use of the HEMD HOTELS Website shall be subject to these general conditions. Use of all websites owned by HEMD HOTELS implies full acceptance by the User of all the General Conditions of Use in force at the time the user accesses the website.

HEMD HOTELS reserves the right to modify these Conditions of Use at any time.

2. Use of the website, services and content

The user undertakes to make correct use of this page, its services and content, without contravening fundamental rights, current legislation, good faith, generally accepted uses, public order, and the particular conditions of certain services. Any use for illegal purposes or that violates the rights of HEMD HOTELS and its owners or a third party, or that in any way harms the normal operation of the page or any computer equipment or documents of any kind contained therein, is prohibited. Regarding the content (information, text, graphics, sound and/or image files, photographs, designs, etc.) the following are especially prohibited:

• Their reproduction, distribution or modification or in any other way their public communication, unless the authorization of their legitimate owners is obtained or it is legally permitted;• Eliminate or modify the copyright and other identifying data of the reservation of rights of HEMD HOTELS or its owners, of the digital fingerprints or any other technical means for their recognition;• Attempt to obtain the contents of the website by any means other than those available to users or those usual on the internet, provided that the latter do not cause any damage to the HEMD HOTELS website• Send messages or send chains of electronic messages that are not requested or consented to by their recipients. • Induces or promotes criminal, derogatory, defamatory, violent or, in general, contrary to the law, morality and generally accepted good customs, or public order; or allows access to products, elements, messages and/or services that are criminal, violent, offensive, harmful, degrading or, in general, contrary to the law, morality and generally accepted good customs, or public order;• Is false, ambiguous, inaccurate, exaggerated or untimely, and may be misleading as to its object or the intentions of the communicator;• Being the intellectual or industrial property of third parties, it is intended to be used without their prior authorization;• Violates the trade secrets of third parties or infringes the regulations on the confidentiality of communications;• In any way undermines the reputation of HEMD HOTELS or third parties, or constitutes, where applicable, illegal, misleading or unfair advertising, and in general unfair competition; HEMD HOTELS or third parties, or that may damage electronic documents and files stored on such equipment;• Contains HTML tags other than those expressly authorized by HEMD HOTELS

3. Intellectual and Industrial Property

All content on the HEMD HOTELS web pages is subject to the regulations on Intellectual and/or Industrial Property. The rights to the content belong to HEMD HOTELS or to third parties, where applicable. The user may only view and obtain a private copy of the content provided that said copy is exclusively for personal and private use, and its use for commercial purposes is strictly prohibited.

4. Disclaimers and Limitations of Liability

HEMD HOTELS shall not be liable for the information, services and/or products offered and/or provided by third parties through the HEMD HOTELS website or for the content provided by third parties. HEMD HOTELS does not guarantee the suitability, reliability, availability, timeliness or accuracy of the information or services contained on its website, nor shall it be liable for direct or indirect damages in relation to the use of the content of its website. HEMD HOTELS does not guarantee that the content of its website is suitable or available outside of Spain. In the event that all or part of the content of the HEMD HOTELS website is considered illegal in countries other than Spain, access to and use of the content by users is prohibited. In the event that this occurs, it will be the sole responsibility of the users, who are obliged to comply with the applicable national laws. Any use that may be made of the information and content that appears on the HEMD HOTELS website and/or access to other third-party websites through connections or "links" that appear on the HEMD HOTELS website will be carried out under the exclusive responsibility of those who carry out such acts, with HEMD HOTELS not being liable in any case for any damages or losses that may arise from such uses or activities.

Processing of Personal Data

In accordance with the provisions of Law 15/1999, of December 13, on the Protection of Personal Data, the user accepts that the personal data provided at the time of their reservation will be incorporated into a file owned by Hemd Capital, SL, hereinafter the company, with B90189010 and registered office at Calle San Roque, 26, Seville, 41001, for the management of the reservation system, the processing of your request, the control and management of the relationship with the users of the website who process reservations, as well as for the performance of statistical studies of the users registered on the aforementioned website that allow for the design of improvements in the services provided. All fields in the forms marked as mandatory must be completed for the correct processing of your requests. The personal data you provide will only be communicated to third parties in compliance with legal obligations or with your prior consent. The user expressly agrees that the bank details provided may be used to cover any penalties for cancellations or no-shows set out in the rate conditions. The processing of your reservations necessarily involves the processing indicated above, so the process cannot be carried out in the event of opposition to it. You may, at any time, exercise your rights of access, rectification, cancellation or opposition as indicated below.

Accuracy of data

In any case, the user will be responsible for the veracity of the data provided, and the company reserves the right to exclude from the registered services any user who has provided false data, without prejudice to any other actions that may be taken under the law. Likewise, the user must be duly authorized to provide data of third parties. Only with the consent of the future hotel guests, the user may enter their names and surnames in the Room Distribution section. Such information, which will allow the chosen hotel to provide a better service to its guests, is optional, so its provision by the user implies, under his or her exclusive responsibility, the assumption of the duty to inform them of the content of our Privacy Policy prior to offering personal information.

Data processing during navigation

In accordance with the obligation set forth in art. 22.2 of Law 34/2002, of July 11, on information society services and electronic commerce, you are informed that the company uses cookies. A cookie is a piece of text information that websites transfer to the hard drive of the computers that connect to them. We use session cookies to identify the user and maintain their identification status. Session cookies are automatically deleted from the hard drive when the session ends. We also use cookies to collect anonymous and aggregate statistics that allow us to analyze how users use our website, in order to improve it. Only the following information is obtained and stored about visitors to our website:

• a) The domain name of the provider (ISP) and/or IP address that gives them access to the network. It will allow us to obtain the following information:

• b) The content design that the user chose during their visit to our website.
• c) Security elements involved in controlling access to restricted areas.

Although the information obtained is, in principle, completely anonymous, in accordance with Report 327/2003 of the Spanish Data Protection Agency, users are informed that the data listed above will be incorporated into a personal data file of the company for the purposes detailed above, and the user may exercise their rights of access, rectification, cancellation and opposition as indicated below.

We also use the Google Adwords remarketing tool. This tool allows us to publish ads on the Google Adwords content network (more details about the Google content network here: https://support.google.com/adwords/answer/2404190) based on users' previous visits to our website. To do this, some of the pages on our website include a code called a "remarketing tag". These tags allow us to read and configure the cookies in your browser in order to determine the specific type of ad that will be shown to the user, based on elements related to their visit to our website, such as, for example, the navigation circuit chosen, the specific pages visited or the actions carried out on them. The remarketing lists thus created are saved in a database on Google's servers, where all the cookie IDs associated with each list or category of interests are stored. With regard to the company, this information can only be associated with a specific user if said user is identified on the website, for example by having completed a reservation process. In this case, the data obtained will be communicated to the company for commercial prospecting purposes and for segmenting the website users in order to design commercial campaigns according to the interests shown during navigation, incorporating the data into a file of the aforementioned entity for the purposes indicated. To oppose the treatment and communication indicated above, the user has the possibility of disabling the cookies, as indicated below:

Hotel Responsibility

Access to the website does not in any way imply the existence of a commercial relationship between the user and the company. The portal only provides information about hotel rooms available at the time of requesting the aforementioned information, so if you make the reservation online, you are contracting directly with the hotel and not with the portal. The printed version of the reservation made serves as a locator when you go to the hotel.

Booking hotel nights on this website implies the client's acceptance of each and every one of the general conditions set out herein.

By accepting the following clauses, you declare and agree:

• 1) Be of legal age and have full capacity to make the reservation, stating that you understand and comprehend all of the conditions found on the website.
• 2) That the data provided when making the online reservation are true, complete and concise.
• 3) Only those pages that appear in the web map are included in the website.
• 4) That access to this website is the responsibility of the user
• 5) Once the reservation has been made, the electronic document in which it was formalized will be archived, and you will be able to access it at any time.
• 6) It confirms the reservation made, that is, the dates indicated, the number of rooms, people and the Hotel chosen.
• 7) The conditions and price of the reservation made are those expressly determined in the rate conditions expressly included on the page where you make the reservation.
• 8) Regarding the relationship with the portal, it gives you the possibility of reserving rooms at the chosen hotel through its website, but does not offer any type of hotel service under its responsibility.
• 9) Your card details are collected in order to guarantee your reservation. Payment will be made in cash at the chosen hotel and only in the case of cancellations or no-shows will the reservation be cancelled and you will be charged as set out in the rate conditions.
• 10) Offers will only be valid for as long as they remain accessible to the recipients of the service.

Prices

The prices indicated are Retail Prices VAT included.

The price includes: Price per night based on the type of room and plan selected, except for hotels where the inclusion of other services is specifically indicated.

The price does not include: Any service not specified, as well as extras such as transfers, tips, telephone calls, laundry services, minibar, parking, etc.

Check-in and check-out times: As a general rule and unless otherwise expressly agreed with the establishment, rooms may be used from 2 p.m. on the day of arrival and must be vacated by 12 p.m. on the day of departure.

Passports and visas

All travellers, without exception (including children), must have their personal and family documentation in order, be it a passport or ID card, in accordance with current legislation. When travel requires it, they will be responsible for obtaining visas, passports, vaccination certificates, etc. Minors under 18 years of age must carry written permission signed by their parents or guardians, in case it may be requested by any authority. In the event that the granting of visas is refused by any authority, for reasons particular to the user, or entry into the country is denied due to lack of the required documentation, or due to a defect in the required documentation, or due to not being in possession of the same, the hotel declines all responsibility for events of this nature, and any expenses incurred will be the responsibility of the consumer, and in these circumstances the conditions and rules established for the case of no-show will apply.
